Heavy Industries Licenses in Egypt

On 3rd December 2020, HE Prime Minister Dr. Mostafa Madbouly issued a new decree No. 47 of 2020 regarding the rules, regulations, and procedures of the licensing heavy industries. (the “Decree”)

The Decree specified that heavy industries shall refer to cement, lime, plaster, iron, steel, tobacco, spirits, and wines.

In accordance with the Decree, the Industrial Development Authority (the “Authority”) shall coordinate with the competent authorities to determine the licensing of heavy industries and the geographical distribution.

The Authority has the ultimate power to determine the locations where heavy industries factories shall be permitted to be established according to authorized geographical distribution and the governmental industrial policy.

The Authority shall announce the available licenses through the national newspaper, the government website and the Authority’s website, indicating the number of available licenses and the production capacity for each license. The Authority shall also have the right – after the approval of the prime minister – to announce licenses through restricted tendering.

The Minister of Trade and Industry shall form a committee to study the applications and verify their compliance with the conditions.
